THAT the Comox Valley Regional District Board approve the Development Variance Permit DV 1C 22 (1249178 BC Ltd.) to:
• Reduce the side yard setback for the northern lot line from 4.5 metres to 3.2 metres for the construction a new principal structure;
• Reduce the side yard setback for the southern lot line from 3.5 metres to 2.2 metres for the construction of a new principal structure; and,
• To increase the maximum height of two new principal structures from 8.0 metres to 10.0 metres specifically for the design described in the report and shown in the figures, on property described as Lot 1 (See EK131251), District Lot 221, and Part of the Bed of the Straight of Georgia, Comox District, Plan 32761, PID 023-611-464 (8958 Clarkson Avenue);

THAT the Comox Valley Regional District Board grant an exemption to Bylaw No. 600 being the “Floodplain Management Bylaw No. 600, 2020” to permit a deck within the minimum 15 metre floodplain setback of the sea (FR 1C 22, Rickerby/ Nishi/ Roland) on property described as That Part of Lot 2, Section 35, Township 6, Comox District, Plan 7996, Lying to the north west of a boundary bearing north 48 degrees 57 minutes east from the point of bisection of the westerly boundary of said lot, PID 003-132-072 (7938 Lenwood Road);
