That a letter of non-concurrence be provided for the proposal to site a tower on the property described as Lot A, Section 37, Comox District, Plan 2241, PID 005-314-941 (3505 Dove Creek Road) to Innovation, Science, and Economic Development Canada, with preference for a further consultation on alternate sites that could service the community;
AND FINALLY THAT the letter highlight the significant opposition and concerns by the community including the correspondence and petitions received.

THAT the Board approve a site-specific request to construct new habitable floor area within the 2100-year floodplain setback and below the flood construction level of Bylaw No. 600, being the “Floodplain Management Bylaw No. 600, 2020,” on property described as Lot 9, District Lot 26, Newcastle District, Plan 18550, PID 000-540-994 (7866 Ships Point Road);
AND FINALLY THAT as a condition of the approval the property owners, at their expense, prepare and register a restrictive covenant under Section 219 of the Land Title Act in favour of the Comox Valley Regional District, specifying conditions that would enable the land to be safely used for the use intended according to the terms of the engineer report prepared by Peter Bullock, P.Eng., M.Eng., of Base Geotechnical Inc., dated August 4, 2023, which will form part of the restrictive covenant, as well as an acknowledgement that no Disaster Financial Assistance funding is available for the building or its contents and releasing and indemnifying the Comox Valley Regional District from liability in the event any damage is caused by flooding or erosion.
