Civic Room, 770 Harmston Avenue, Courtenay, BC commencing at 10:00 am.

The chair of the committee will preside over the meeting according to the CVRD procedure bylaw. This meeting may include participation by members of the committee via electronic communication.

This meeting is not meant for general public input. If members of the public wish to speak at a meeting, they should contact the CVRD Legislative Services Department to request to appear as a delegation. Live webcasts and recordings are available at www.comoxvalleyrd.ca/minutes-agendas

In the event of an emergency the public gathering place is the parking lot outside the Civic Room.

Report dated January 6, 2025 regarding Zoning Bylaw Amendment RZ 3C 24 – 1485 Hillview Road (Schaad) to rezone land from the Mobile Home Park zone to the Rural Eight zone and a recommendation for external agency referral for receipt. [Item

Recommendation:
 
THAT the agency referral list as outlined in Appendix B of staff report dated January 6, 2025, be approved and staff be directed to commence the external agency referral process for Lot 8, District Lot 249, Comox District, Plan 22193, PID 003-377-369 (1485 Hillview Road) as part of a proposed amendment (RZ 3C 24) of Bylaw No. 520, being “Rural Comox Valley Zoning Bylaw, No. 520, 2019”;

AND FURTHER THAT consultation with First Nations be in accordance with the referrals management program dated September 25, 2012.

Report dated January 8, 2025 regarding Commercial and Industrial (Form and Character) Development Permit DP 22A 24 - 501 Holiday Road (Fanny Bay Resort Inc.) for development of a campground containing 46 camping sites, a single-detached dwelling, two tourist accommodation units and several related accessory buildings for receipt. Recommendation:
 
THAT the Comox Valley Regional District Board approve a Commercial and Industrial (Form and Character) development permit (DP 22A 24 – Fanny Bay Resort Inc.) for the development of a Recreational Vehicle Park containing 46 camping sites, two tourist accommodation units, a single-detached dwelling, and several related buildings generally in accordance with the site plan shown in Appendix C, on the property described as Lot B, District Lot 44 and of Lot 37-G, Section 2 and of Section 2-A, Nelson District, Plan 30021, PID 000-379-930;

AND FINALLY THAT subject to the receipt of a landscape security deposit of $133,750.00, the Corporate Legislative Officer be authorized to execute the development permit.

THAT the 0.41 hectares (1.0 acre) of land legally described as Lot 15, Plan 4716, Section 6A, Nelson Land District (PID 005-996-511) and owned in fee simple by the Comox Valley Regional District and referred to as Fanny Bay Community Park be added to Schedule A - Comox Valley Regional District Parks and Schedule F – Park Maps of Bylaw No. 103 being “Electoral Areas Parks Regulations Bylaw No. 103, 2010”.

Recommendation #2:
 
THAT the 0.4 hectares (0.9 acres) of land legally described as Lot B, Section 5, Comox District, Plan VIP83414 (PID 027-126-528) which is managed by the Comox Valley Regional District through a Covenant and a Statutory Right of Way registered through Section 219 of the Land Title Act be added to Schedule A - Comox Valley Regional District Parks, Schedule B - Comox Valley Regional District Animal Control Measures, and Schedule F – Park Maps of Bylaw No. 103 being “Electoral Areas Parks Regulations Bylaw No. 103, 2010”;

AND FURTHER THAT this park be referred to as Mallard Creek Conservation Area.

THAT the 1.83 hectares (4.52 acres) of land donated through the Ecological Gifts program legally described as Lot A, Section 25, Township 6, Comox District Plan EPP129542 (PID 032-332-777) and owned in fee simple by the Comox Valley Regional District be added to the Maris Nature Park map in Schedule F – Park Maps of Bylaw No. 103 being “Electoral Areas Parks Regulations Bylaw No. 103, 2010”.
