BLACK CREEK - OYSTER BAY SERVICES COMMITTEE

Civic Room of the Comox Valley Regional District offices located at 770 Harmston Avenue, Courtenay, BC commencing at 9:00 am.

The chair of the committee will preside over the meeting according to the CVRD procedure bylaw. This meeting may include participation by members of the committee via electronic communication.

This meeting is not meant for general public input. If members of the public wish to speak at a meeting, they should contact the CVRD Legislative Services Department to request to appear as a delegation. Live webcasts and recordings are available at www.comoxvalleyrd.ca/minutes-agendas

In the event of an emergency the public gathering place is the parking lot outside the Civic Room.

1) WATUTCO LEGISLATIVE PROCESS AND AGREEMENT
 
Report dated August 7, 2025 regarding the agreement for the transfer of assets from Watutco Enterprises Ltd.) to the Black Creek-Oyster Bay Water Local Service Area for receipt. [Item

Recommendation #1:
 
THAT the Watutco Asset Transfer Agreement between the Comox Valley Regional District and Watutco Enterprises Ltd, in a form substantially consistent with Appendix A to the staff report dated August 7, 2025, be approved.

Recommendation #2:
 
THAT staff proceed with a petition process for those property owners within Electoral Area C (Puntledge – Black Creek) that fall within the area proposed to join the Black Creek – Oyster Bay Water Service, as outlined in Appendix B to the staff report dated August 7, 2025;

AND FURTHER THAT if the petitions are sufficient and valid pursuant to the Local Government Act and the Regional District Establishing Bylaw Approval Exemption Regulation, staff be directed to bring forward:
- the service establishment bylaw for the purpose of providing capital financing for the system modifications and connection to the BCOB system;
- loan authorization bylaw for the borrowing of necessary funding; and
- an amendment to Bylaw No. 1557 being “Black Creek and Oyster Bay Water Local Service Area Conversion and establishment Bylaw No. 1557, 1993” to add the properties to the Black Creek – Oyster Bay Water Service;

AND FINALLY THAT subject to sufficient and valid petition being received, the Directors for Electoral Areas C and Strathcona Regional District Area D being the service participants, consent to the amendment of Bylaw No. 1557 being “Black Creek and Oyster Bay Water Local Service Area Conversion and establishment Bylaw No. 1557, 1993” in writing.
