REPORTS
FARM LAND PROTECTION DEVELOPMENT PERMIT DP 11B 21 – 1226 DON ROAD (POTTER-COGAN)
 
 
J. MacLean, Planner II, provided an overview of the memorandum dated November 3, 2021 regarding Farm Land Protection Development Permit DP 11B 21 – 1226 Don Road (Potter-Cogan) to enable the construction of new buildings within 30 metres of an agricultural property. [Item
 
 
With the consent of the commission, Heather Gjesdal, adjacent neighbour, provided comments regarding the Development Permit application DP 11B 21 – 1226 Don Road (Potter-Cogan).

C. Brown joined the meeting via electronic means.
 
 
B. Thompson/W. Prothero: THAT the Agricultural Advisory Commission support the Development Permit application DP 11B 21 – 1226 Don Road (Potter-Cogan) as proposed in the memorandum dated November 3, 2021 for the following reasons:

• The property is located in a residential area adjacent to land designated ALR and except for that fact, is in keeping with area development and zoning;
• The adjacent ALR property area next to the proposal is developed as residential and is not likely to be used for any serious agricultural enterprise in that immediate area;
• The applicant has constructed a six foot metal panel fence separating the properties as well as planted Portuguese Laurel hedging. There is no visual nor other hindrance to any activity on either property;
• The proposed building site is repurposing an existing foundation meaning no more impact than already exists;
• The space from the building site to the boundary fence is 19 metres of open yard;
• This is a reasonable development request without any impact on ALR land use.
 Defeated
 
The following members voted in opposition to the above-noted motion: C. Brown, G. McClintock, A. Burch, M. Halstead, R. Poirier.
 
 
R. Poirier/W. Prothero: THAT the Agricultural Advisory Planning Commission support the Development Permit DP 11B 21 – 1226 Don Road (Potter-Cogan) as proposed in the memorandum dated November 3, 2021 with the recommendation that the vegetated buffer be planted on the entire boundary with the adjacent agricultural boundary, with the following rationale:
• the screening and buffering should not rely on the trees on the agricultural land but should make provisions on the residential side;
• the additional vegetative buffering would be a good additional measure for buffering sound in addition to the fence currently and especially if the land were used more intensively for livestock or other agricultural uses;
• that Portuguese laurels or Leyland Cypress would be suitable options for plantings;
• acknowledging the proposed new building is increasing to a two-storey structure and extending closer to the boundary with the lean-to, the septic will also be within the buffer area, which isn’t ideal, though due to the small lot sizes this is unavoidable.
